Specific Instructions
This clause allows parties to outline tasks to be completed by the Child Care provider in a certain specified manner.
Authorization to Access/Release
This clause allows parties to detail all those who are allowed to pick up the child and/or visit the child while in the care of the Child Care provider.
Term of Agreement
End date of the Agreement Q. What is the end date of the agreement?

A. The end date is the date when the services under the agreement are no longer provided or needed.
Notice period before end date Q. What does "Notice" mean?

A. Notice refers to the amount of time that is provided by one party to another when they wish to end their obligations under the agreement prior to the agreed end date.
Remuneration
How will the Child Care Provider be paid Q. How should the Child Care Provider be paid?

A. The Child Care Provider can be paid or remunerated in many different ways. If the Child Care Provider will be paid a certain amount (rate) for each time period, use "Hourly", "Weekly", "Monthly" or "Yearly" as appropriate.

Is there any additional remuneration Q. What is additional remuneration?

A. Additional remuneration refers to any remuneratory benefits for the Child Care Provider other than payment for services.
Will the Customer be providing anything to the Child Care Provider Q. What items should be provided to the Child Care Provider?

A. If the Customer wishes to provide any services, tools, office space, materials, etc. to the Child Care Provider to perform the services, then the Customer should select "Yes" to the question "Will the Customer be providing anything to the Child Care Provider?" and then describe what he/she is providing.

Will the Child Care Provider be Reimbursed for Expenses?

Penalties for late payment Q. What does "Penalties for late payment?" mean?

A. This question refers to whether the Customer will be penalized for failing to pay the Child Care Provider on time.

Duty of Care Q. What is a "Duty of Care"?

A. A "Duty of Care" is a legal term which refers to an obligation placed on an individual to exercise a reasonable amount of care to prevent injury to others.
This provision allows the parties to explicitly state that the child care provider accepts a general duty of care that extends to all reasonable and necessary situations under the contract.

Limitation of Liability
This clause allows the parties to completely absolve the Child Care Provider in the event that any losses, damages or any other liabilities arise out of the services provided.
Restrictive Covenants
Confidentiality Q. What is a confidentiality clause?

A. The confidentiality clause prevents the Child Care Provider from using or disclosing the Customer's confidential business information to a third party.
How long will confidential obligations exist after agreement ends?
Dispute Resolution
Unresolved disputes go to mediation before arbitration? Q. What do "mediation" and "arbitration" mean?

A. Mediation is a process where an impartial 3rd party or mediator facilitates the negotiation of a settlement between parties to a dispute.

Arbitration is a process whereby parties to a dispute mutually agree to an impartial referee who hears and makes a binding decision.
